My question involves adoption law for the State of: Florida
I have a 12yr old son from a previous relationship (never married to him). We split up 8mons after my son was born. I met my husband around that same time. We married in late 2004. My ex quit having any contact with my son when he was 18mons old. He has contacted me once on myspace in 2006ish and once on facebook in 2012---in 2012 he told me he was ready to be a father and wanted photos and info on my son. I declined and he never filed anything even after threatening me he was. I have hired a paralegal as I figured since he has never paid child support and hasn't had contact with My son since he was 18mons that he would just sign and be done. I was confident going into this, but now we had an investigator go to his home to see if he would just sign the papers, his wife answered the door and told the investigator that he was threatened by my husband, myself, and my parents that he needed to leave my son alone or ?!? I am not sure what she stated would be done so I don't want to misquote her. There have never been threats other then in 2012 I did tell him if he was ready to play daddy and my husband has cared and paid for him all these years, he would have a ton of arrears to pay and that he should just sign him over to my husband. At the time my son, didn't know about his biological dad. I thought at the time it was just the best thing and our families never said a word nor treated him any different. We have told him now about his biological father and he wishes to be adopted by the only Father he has known in his life and also signed consent to be adopted by my husband. I am just wondering how will my ex have to prove he didn't abandon him? What is considered proof? There has never been an order of support or visitation. How often do judges give men like him a choice in a step parent adoption? We are hoping he just doesn't show up but I do want to prepare my son for any outcome I can. Right now, he is super excited to have his dad's name and be like all of our names. He knows no matter what my husband is still his daddy, even if his biofather wins and decides to step up.

I also have facebook messages from his ex wife, asking why I took my son and ran. That he was calling DCF constantly and trying to get their son taken from her. He is telling each wife a different story to cover why he has nothing to do with my son.
