Suspension and Revocation: Preventing the Inevitable Suspenion

samedi 21 mars 2015

My question involves a driver's license issued by the State of: Illinois

Hello,

I have an Illinois license. I have received a tickets in Wisconsin and Missouri. I am under 21.

According to Illinois law: Two moving violation convictions occurring within a 24-month period results in a minimum one-month driver’s license suspension. Suspension length is determined by the seriousness of the offenses and the driver’s prior driving history. An additional driver’s license suspension will result for each subsequent moving violation following the initial suspension.

That applies to me, as I am under 21.

This past Thursday I was convicted for my ticket in Missouri, and I turn 21 in 5 days. I have an attorney now who says that by withdrawing the plea in Missouri by next week and then getting a Missouri license, I can prevent the suspension of my Illinois license. Does this sound right?

I wasn't aware that my license would have been suspended, so the concept of "manifest injustice" was thrown around.

Does the date of the ticket/violation differ from the conviction date? Does it matter when I received the ticket or does it go by conviction date?

Thanks!
