Appeals: Dismiss My Own Appeal

mardi 10 mars 2015

My question involves traffic court in the State of:Pennsylvania

Received a speeding citation 49 in a 35 on 1/27/2014.

Paid fine in full and pled not guilty on 2/4/2014.

Original court date was missed, causing default judgement to be filed.

In May of 2014 appeal was filed.

In December of 2014, politely called their offices to inquire about docket of case. Was told this would come in January.

Fast forward to end of February.

No paperwork was received by this time.

Had a bad day, called the court and was confronted by discourteous employee. I raised my my voice a little, citing due processes of law.

Finally received a letter from the court last week with a date of 4/27/2014.

I am really sorry about calling the court and getting upset.

I am switching to a new city to start a new job and money is tight, creating stress.

I am considering having my case dismissed. I originally intended to fight, even though i feel strong about the situation I want to cut my losses.

1) How does one dismiss their own case? What are the chances any such motions would be successful?

2) Should I apologize and would a letter of apology be sufficient to the court?

Please help!
