Custody and Visitation Issues: Non-Biological Dad but Birth Certificate Father

My question involves a child custody case from the State of: Tennessee



First off, I am in the Army. I signed the birth cert for my son after knowing that there was no chance he was mine. Me and his mom were highschool sweethearts and a moment of indiscretion didn't throw it away for us. Anyways she got pregnant while I was away at AIT for the Army and all was okay for about a year and a half. When I got deployed she left me for another individual and despite me being the only father he has known up to that point since I've returned home she has been trying to get our divorce finalized. The only part we don't agree upon is where I am not the biological dad she wants her new boyfriend to play "daddy" and me to give up my rights. We've been back and fourth with this for almost a year and a half now. My son is 3 and a half and still to this day I still keep him periodically when I can due to relocating. Do I have any rights to my son even though I am not his biological father. I feel I am what is in his best intrest and I love him to death. A bit about the bio-dad he is addicted to drugs and doesn't work and has no desire to step forward, mom and her new bf have already had a CPS case opened for her using drugs when she was pregnant. I know she is still doing drugs, and have let it be known to her caseworker. I also have photographic evidence of her slapping him around leaving marks, but CPS refuses to do anything. Additionally, the boyfriend is on welfare and only works just enough to keep his benifets. The ex wife doesn't work at all. The largest portion of their income is what the Army makes me give her despite it all. Also I can't really afford an attorney cause I gotta live, plus pay her expenses and all that. Now I feel that I am at an impass.
