My question involves criminal law for the state of: Michigan
On the 17th, my husband and I got into a fight in which he grabbed a handful of my hair, and threw me out of his way because I was not moving when he told me to go to bed. We both were at fault, and I just wanted to leave, so I called his mother to come get me. Instead she called the sheriff, as she heard him shouting to go ahead tell her I ripped your hair out. He left, but they pulled him over and he was arrested for domestic violence anyways. I wrote a statement saying exactly what had happened, and was told regardless of if I want to press charges, they were going to anyways. He was booked, held for the mandatory 24hrs or whatnot, and arraigned on the charges. They did not offer him an attorney, or legal advice of any kind (as his mother told me), so he plead guilty and was released on bond. There is currently a no contact order in place, which is causing extreme stress in this already stressful situation. We have 4 children, and his mother has named herself 100% responsible for her son, and has made this an impossible situation. Twice my children have been returned to me on school nights after midnight for one of her million excuses. Is there anything I can do to get the no contact order dropped? And isn't it standard procedure to offer legal counsel when you're arrested? I mean, I know about the Miranda rights, but before going to arraignment, shouldn't he had been offered one? According to his mother, since he couldn't afford one, he didn't get one. I'm sure we've all seen enough Law & Order to know you don't need money for representation, right? I know there's nothing I can do about the charges, and this is his first ever offense, to me, domestic violence or otherwise. He's had a clean record, but his mother is telling me he'll serve 93 days in jail at least for this. Anyone offer advice? I'm at my wits end with this woman dealing with this unfortunate situation.
