My question involves traffic court in the State of: washington
Hello. I requested discovery for the charge of negligent driving in the second degree resulting from an accident on the highway where I rear ended someone. The officer was not present at the time of the accident. In his statement the officer states that I was traveling too fast for traffic conditions and too close to vehicle in front of me in order to charge me with negligent driving. I was 20 miles under the speed limit and was not traveling faster than any of the other cars in my immediate area. If anything I am only guilty of following too closely. I was wondering if there is any way I can beat this case? The officer is the only "witness", there are no other statements from anyone else as well as the driver I rear ended and since the officer wasn't there how can he be witness without any statement from anyone else at the scene? How can he judge that my speed was too fast for traffic conditions when he has no idea what the traffic conditions were?
