My question involves landlord-tenant law in the State of: PA
We allowed a family member to temporarily stay in our home due to a medical issue. He was unable to safely live in his apartment due to the steps. He was supposed to immedietely look for a handicapped accessible apartment and seek out housing assistance to help cover rent since he was now receiving SSD. We were thinking in 1-2 months he should be able to find a place, this was the verbal agreement. We were also open to a little bit more time if he needed to be on a waiting list for a proper wheelchair setup apartment. Needless to say it has been several years and he refuses to look for anything and just will not leave. There is no lease and he occasionally gives a check to us with "food" written on the memo section. We have just felt bad for him so allowed it to happen, it is our fault completely. We understand that since he has stayed for so long he has some inherant rights as a tenant to reside here despite no lease or rent paid as well as us frequently encouraging/requesting him to find suitable housing for himself.
We are now planning on moving in the near future, downsizing to a much smaller home since our children are grown, he will not be able to come with us for various reasons. We are not sure if we are selling our home or rather using it as a rental unit. In any case, financially, he would not be able to rent a 5 bedroom home, so it is not possible for him to stay here without us. Since we have no lease or verbal agreement for him to stay beyond 2 months, what type of notice am I required to give this person? Does he have any rights to move with our "household"? Do we just give him notice of the dates of us moving, home sale or renter occupancy and leave him be? I would assume if he still wont go when someone is scheduled to take possession I would need to do a full on eviction? That could really hold up a sale/ lease for us.
