My wife is holding H1b visa, and recently she just got her I-140 approved. My status is H4 visa.
We are preparing file the I-485 form, but my situation is kind of complicated.
During my H4 visa status, I have invested one of my friend’s company. I don’t know if the immigrant officer will consider me as working at that company. I know I can’t work at that company, and I didn’t get paid. During that time, I had my first baby born, I was staying at home taking care of my baby. If they think I was working during the H4 visa status, I probably will be rejected. So how can I resolve this problem?
Second, on the second of year of this company, my partner bought the stolen iPhones from local minor people (a kid). So the police arrested both of me and my friend. We are charged 1.unlawful purchase items from minor, 2. keep the stolen property, 3. second hand dealer not keeping record. That day I was in the company and my name is on the business license, so I was arrested too. And later the court stricken off my name and the case was expunged.( the attachment is the police report, the court disposition certificate and the expunge report ) After that I withdrawn my money from the company and we close the company. Is this criminal record will affect my I-485 approval and how can I deal with this. Do I need to write statement about the case when filing the i485.
Last year, I traveled back to china, I got a very big problem trying to re-enter the America. The visa officer in consulate think that H4 visa people investing company can be considered as working in that company. It is illegal. They did’t want give me H4 visa at the beginning. But they finally give me H4 visa to come back to US because my wife was pregnant 8 month at that time.
