My question involves child support in the State of: Original Support Order, NY, Collecting state, GA collects and pays Virginia - it's complicated.
My oldest step-daughter will be turning 21 April, 2015. She was married Dec 2014, prior to that she moved from the custodial parents home, being self-dependent since July 2013. The other step-daughter turned 19 Jan 2015, graduated June 2014, and is in the National Guard. We do not know if she is living on her own or not since she has chosen since the age of 9 to have no contact with her father.
Papers have been sent to all states to have the support modified from the $150. a week to being stopped numerous times. GA has finally stated they will try to get a judge to take the case, but no one will as to date, this has been since Dec 2014. The father has been paying $50 a week extra towards arrears also, total of $800 a month is garnished from his pay check. VA shows as if he's never been paying towards the arrears, but he has since 2010. Another note is when he lost his job in 2005, he ask NY for modification and they denied it stating that because neither parent lived in NY any longer (this was when we first learned that she had moved out of state also and did not tell him and he had joint custody, but could not visit due to the burden of expense. NY kept the money and threw the case out of court. So, instead of the the support being stopped until he found work, it continued to accumulate. In a spreadsheet we kept, factoring in the minimum he could of tried to pay of $30 a month, he has paid above (we figure over $23,000) what has been owed, especially since he has paid for the almost 2 years since his oldest moved out and she has received his tax refunds over this time period as well. The mother has not given any of the money to her either. She might try to say she was giving it to her parents as that is where she was staying, but she was working and living with her boyfriend both in FL and NY.
So far the mother has moved from NY to VA, filed there and that is when VA got GA involved to collect. She then moved to FL and never had the support changed from VA. She then we learned in 2013 moved to GA around the Townsend area. When he contacted NY, they state that they have no open case, VA states that they have no court order but are collecting for GA.
No one wants to help - to us she is committing fraud collecting the money when a child did not live with her. The mother's income has never been factored in either, she did not work at the time of the separation in 1996 and later gained employment and has worked since.
All I can say is HELP!!!! Is there a higher court we can take this to?
