Probation and Parole: I Want to Leave the State Before Completing My Probation

jeudi 19 mars 2015

My question involves criminal law for the state of: Wisconsin/Minnesota

I currently live in Wisconsin but very near the Minnesota border. In 2013 I was arrested and charged in Minnesota with possession of 1/10th of a gram of heroin. Because I live in Wisconsin I had my probation transferred to Wisconsin. I've only been on probation for about 6 months and I have to do a maximum of 5 years. My first 3 months on probation I was not complying, I was still using drugs but my PO never did anything about it. Then finally in January 2015 she gave me the choice of going to jail or detox. I chose detox and have been clean for 2 months now. When I got out of detox however she decided to put me on electronic monitoring. I have a job and have been doing day treatment out of town so my restrictions are very minimal (have to be home from 10pm-4am). I have been on the bracelet for 2 months now and am hoping to be off soon. However I am contemplating moving to Florida with my boyfriend (who currently has active warrants in WI but is originally from FL).

I realize that if I go down to FL and get pulled over or have contact with police that they will run my info and there is a possibility I could be extradited back to WI/MN to face the consequences. I also know that for such a small drug charge (even though it's a felony) it's probably unlikely that would happen. What I really want to know is what would happen if I made the choice to go to FL BEFORE I am off the ankle bracelet...as in...(dumb i know)...cutting it off just before I left? It is NOT a GPS monitor, just tells if I'm within range of the box at my house. Would they be MORE LIKELY to extradite because of this?

Also, I know that if I do choose to go to FL that I would not be able to get a FL driver's license, correct? How about things like marriage licenses?

And if my original charge was in Minnesota, let's say I had law enforcement contact in FL, would WI or MN be the state to determine whether or not to extradite?

Please and Thank You :)
