My question involves a child custody case from the State of: New Jersey (currently)
I have joint custody of my 8 year old daughter with her father. About a year and a half ago we moved from NJ to Virginia but kept the case in NJ. My daughter's father and I entered into a Consent Order regarding my move wherein I have provided the transportation of my daughter to NJ approximately 4x a year. Now my daughter's father has advised me that he is moving to Nebraska and wants me to provide transportation for her to Nebraska twice a year. He is claiming that because he is disabled (he receives Social Security) and unemployed he cannot provide transportation. Unfortunately, I am a stay at home mom of four children with my husband being the only person who works (he is in the military). We cannot pay for my daughter to get out there.
Will NJ make me pay for all the transportation when he is the one that moved half way across the country?
Should I attempt to have the case moved to Virginia as this would be my daughter's home state and he is requesting a change of parenting time due to him moving out of state?
