Suspension and Revocation: Driver's License Suspension Under the Surchargable Event Law

My question involves a driver's license issued by the State of: Massachusetts



I will keep this post brief as I have only two questions regarding a recent rear-end accident and my license. I have priors on my driving record- an accident in 2008, and minor traffic citations- 1 in 2008, one in 2009, and two in 2010. I have a major for an OUI in 2012.



My license was to be suspended 30 days due to the 3 surchargable event law in two years law in the State of MA. However this suspension was nixed in favor of the 45-day suspension for the OUI in which I took a CWOF on. I took the suspension, the courses mandated and successfully completed all of the probation. I took a driver course mandated by the state and actively improved my driving. I was incident free for 2 1/2 years until this past Friday when I was involved in a very minor rear end accident.



My questions are as follows- If I am found to be at fault with this accident (which is likely being a rear end accident) what is the likelihood that my license will be suspended? I don't fall into the 3 events in two years category, or the seven events in 3 years. Under applicable HTO laws I don't have 3 majors or a combination of 12 minor/majors in 5 years to classify as that. What grounds would they suspend on? Immediate threat?



Also if the 30 day suspension was not served (as they opted for the judges 45-day ruling), would they retroactively make me serve that 30-day suspension? Either way I am curious, and am in the process of waiting for the registry and getting an attorney lined up in case this happens.
