On April 2013 I was accused of stalking a coworker. Allegedly we were arriving to work at the same time, then I would follow her into the building. I denied the allegations because I had no way of knowing what time she (or anyone else) arrived to work. However, she didn't believe it was coincidence we were arriving on the parking lot at the same time, and she thought I would "plan" to get there at the same time she did. For her claim to be valid, I would have to know where she lived and what time she left her house, but I don't know either of those things. Even if I was following her, where would I follow her? I would just go to the front desk to sign in (just like everyone else), then go to my work station.
I reported her to the boss, then I was put on administrative leave while they investigated. A week later, a police officer came to my house. He had a letter from the boss informing me I was suspended without pay, and he also an arrest warrant for "harassment." I was taken to jail, but I got out half a day later after posting bond. I then filed a police report to accuse the company of framing me, and a week later I got a termination letter.
I then contacted an attorney, but he was terrible; he pretty much sided with the opposition, and I later learned from past clients that he had a habit of doing so. I made my first court appearance on November 2013, and I would report once a month because "they still needed more time." Then on February 2014 I was put on 1-year pretrial diversion. I had to do things such as pay fees, report to probation once a month, take a drug offender course even though this wasn't a drug issue, and stay away from the "victim" even though I've never really talked with her.
I have completed the terms of the contract, and the case was dismissed "on the grounds of insufficient evidence." I now have to work on expunging the record. Can I sue the company for framing me?
