My question involves labor and employment law for the state of: Ohio
A few things, the reason i was given for being fired was and i quote "you have been spending too much time with employees outside of work, and for that we are letting you go."
The official reason that shows up on my online record from this company says "GROSS MISCONDUCT"
From what I've read about what constitutes as gross misconduct, I do not believe my violation fits this description. I am wondering if this is a way for them to try and deny me unemployment? (I should note, there is a non-fraternization policy within our company, but it was my understanding this was more for dating, and drinking/ purchasing alcohol, putting yourself in vulnerable situations, etc.)
Also it troubles me, that the last time I did go out to a drinking establishment with staff my boss, and the other male manager was there. The boss bought me a drink, and the other manager is known to go out with staff frequently. One of the reasons given of spending too much time with employees for me was my going to the gym with a staff member that I was a manager of. The other, male manager often plays basketball as a workout with staff as well, and has even invited me several times. My boss even told me "I know you aren't much of a partier and aren't going out to the bars with the staff a lot, but you should stop going to the gym with "said employee"" Again, he did not have any discussion about this with the other male manager.
Im wondering is there a way to request or even to legally insist that they change the record of termination? Am i wrong to feel like I have been discriminated against, or should pursue legal action regarding me being terminated and "told on" by the boss, when the other male manager was not?
