My question involves vehicle maintenance laws for the State of: New York
I received a ticket yesterday for having illegal tint on my car, I'm a florida resident and my car is registered in Florida. I advised the officer that he was not able to give me a ticket due to New York Vehicle & Traffic Law, Sec. 250(1). He tried to tell me some thing about a judge deciding what would happen and proceeded to give me a ticket. He asked me what the legal tint was in Florida and I said 20 something percent, He then tested my tint and put on the ticket that my tint was 15 percent. I have written documentation from the licensed tint company in florida that installed it on my car that states my tint was 35 percent in the front and was legal according florida law which is 28 percent.
I know that according to New York Vehicle & Traffic Law, Sec. 250(1) this ticket should get thrown out but I feel like I'm going to have an issue because the officer put 15 percent on the ticket. I have the original documentation for the tint and plan on issuing a written response with all these facts before the court date along with attaching my registration to prove non residence and then attach the tint documentation to battle his claim for tint. I want to know the proper procudure to do this , and if there is a particular document that I should be trying to file prior to the court date to make sure the judge sees all of this in writing. I would also like to know the procedure to request documentation for calibration of his tester or if I should wait and ask for it at court, or if they even consider the calibration of devices a factor in deciding. I have heard NY traffic court is a bit biased but im pretty confident that this will be an easy ticket to contest.
I also wanted to know the best way to file a complaint against the officer here in NYC. I feel the need to disclose this officers corruption and disregard for the law. I was even thinking of pursuing a civil claim myself just for fun and would love to see any case law on cases similar to mine.
I have beaten tickets in florida and gotten out of tickets here in New York by citing laws to officers but this officer didn't care about the law I cited and ill admit I had a bit of a grin on my face while talking to him so I probably pissed him off. I should also disclose that I am in New York visiting family prior to my first year of law school this fall and in now way will be considered a New York resident.
