I have a domain name which is similar to: DrupalWebsiteMaker.net
The entire website is about creating websites using the drupal platform (under their licensing you can create drupal websites and then sell them to customers) That is not the problem. The problem is using the word Drupal in the domain name which describes what we do. We are a website maker for the drupal platform.
We do not anywhere on the website claim we are affiliate with drupal. We do not use any logos of drupal. We do use the word "drupal" on the website clearly states that we customize and build on the drupal platform. In no way do we try to confuse visitors or lead them to believe we are the official drupal or are supported by drupal.
I have had a lawyer who specializes in UDRP offer to take on the case and he says hes "optimistic" about winning it and he specializes in IP / UDRP cases.
I need advise because this is the situation. I don't want to get sued if I win the UDRP. Here are the facts.
1. I'm a US citizen
2. I've been living and going to school abroad for the last 4-5 years now.
3. I have no assets in the US
4. I have a US bank with no money in it as all my money is abroad (where I live)
My questions are:
1. If I win the UDRP how likely is it that drupal would come after me in court
2. How can they sue me if I don't reside in the US
3. If I came back to the US could they still sue me?
4. How many times can they try to sue me?
5. Will this in anyway mess with my citizenship? Will this prevent me from filing for my wife to become a US citizen?
6. If i do go back to the US and they sue me can I file for bankruptcy since I don't have any credit or assets anyways?
7. Can they get the domain if they lose the UDRP case and can't sue me since I'm not currently in the US?
I know its a lot of questions but I just need help.
