My question involves employment and labor law for the state of: CA
This is in reference to an Employment settlement in CA, surrounding issues of back-pay, overtime and liquidated damages. After 2 months of negotiations, We reached settlement first week of March, and my lawyer said that they now draw up the Settlement Agreement, (possibly) go back and forth on the terms, and then present both parties to sign. At that point, he said a check is issued to the attorney, and then after fees are deducted, to me. He did state that what he meant by terms was specifics such as confidentiality, no further suing, etc -- he stated the dollar amount agreed on in settlement can not change.
My question is, how long is this process typically? Does the final signature have to come from a judge, or not, seeing as never went to court or even filed anything outside negotiations between the 2 lawyers ? My lawyer stated there's a good chance I will have the check by end of March; I did not realize that drawing up the actual Agreement could take more than a few days/week. Any insight here would be very much appreciated. Thank you
