Unemployment Benefits: Is My EDD + 1099g Scenario

vendredi 6 mars 2015

My question involves unemployment benefits for the state of: CA

I've just started collecting unemployment after being laid off, and have been offered a part-time commission based sales role (on 1099 basis), where I receive a percentage cut of the revenue brought in from my efforts. I'll be paid in a lump sum 6-7 months from now, shortly after the UI checks are fully exhausted (26 weeks).

How do I go about writing down, 1) wages earned and 2) total hours worked on the Continued Claim forms? I will not know until the very end when the lump sum (if any) is granted to me.

CONVERSELY,

if I don't take this part-time contractual job, I may have something similar lined up in September (1099 as well), which is also after the UI checks have exhausted. If I receive a 1099 at the end of the year for the services I've provided for this stint starting in September, will this raise a red flag to EDD when they see that I've had realizable income at one point in 2014, when I was also receiving UI checks within the same year of 2014? If so, will I/employer have to prove to EDD that the 1099 independent contractor job was AFTER my unemployment benefits ran out? Do they ever have the claimant or the 1099 issuer (company) submit pay stubs and dates worked as evidence? To my understanding the 1099 form does not state either payment issued NOR dates worked.

I'd rather figure these ambiguities out now to avoid any headaches later down the road. Thanks for your input, everyone! Much appreciated. :)
