My question involves an eviction in the state of: California, Sacramento
My husband and I were a few months late with rent, because he was not getting paid from the company he works for. On Aug. 20, 2014, we received a Three-Day notice. The dates listed and the amounts
that were listed were incorrect. It said that from April 1-April 30 we owed $350.00, and May 1- Aug. 31 we owed, $3500. This is incorrect. We have rent payment receipts for April and June. So we did owe for May, July and August. We deposited $3000.00 into the owners account on Aug. 25.
On, Sept. 13, we received another Three-day notice for Aug. 1- Sept 30 we owed $1725.00. I might add that last October the current owner purchased the duplex. It was foreclosed on and purchased by an investor and then sold to the current owner. A few days after he became the new owner, he came over and we told him that we had an agreement with the previous owners, that we could pay our rent between the 15th and 20th every month. At the time, my husband was working for a different company and he usually was paid between those dates. He agreed with that.
The notice we received on the 13th of September was dated September 10, 2014. We did not pay the amount listed, but did deposit 200 into his account, and the remaining balance for Septembers rent would have been paid that coming weekend. On the 18th, I signed for a certified letter and it was from the owners attorney, stating they were not accepting the partial payment and a check for that amount was enclosed. He also stated in his letter they would proceed with an unlawful detainer.
Going by the dates from the notices, we have gone over our receipts and the Aug. payment of $3000.00 actually had a remaining balance of $225.00,which should have been applied to Septembers rent.
So, here's the thing... we filed our answer to his complaint and have a trial date for next week. The attorney called us this morning and after I spoke with him, its clear, we need an attorney. Because he was very intimidating and frankly quite rude, which I know that's pretty much how it is, but I think we have vaild points regarding this and just don't know what to do.
We are in need of a good attorney who fights for tenants in Sacramento, CA . Any help is greatly appreciated!!!
