My question involves labor and employment law for the state of Pa. We work as pharmacists in a hospital. Over the years the long term employees (over 40 years old) have worked their way on to day hours. The evenings are worked by new hires - (younger - under 40 years old) employees who were specifically hired for this. This is how it worked for many years.
A manager recently decided they were not going to hold the younger employees to the schedule they agreed to work when hired. As a result the older workers are going to have to work many, many more undesirable shifts and the younger workers will work some of the day shift hours. When the long term employees questioned the manager about this he said there are four other people who will take your job if you don't want it. Also said was there isn't a union here so I'm going to do what I want. We think management is doing this because the older workers earn about 25K more per year and hope the new undesirable hours will cause some of them to leave. Is this discrimination? Thanks.
