Medical Malpractice: Help

My question involves medical malpractice in the state of: Virginia



My wife went to get her tubes tied on a Tuesday. After that procedure my wife was in severe pain and kept complaining to the nurses that she felt that something wasn't right and that the pain she was experiencing felt worse than being in labor to give birth. She was in tears. They told her that it was just some kind of gas they use for the procedure and it should wear off in a day. So they discharged her from the hospital and told her to fill her prescription for pain. We got the prescription and went home. She ate some food then took the prescribed amount of the prescription. She was still in excruciating pain so I called the doctor, who left me with his phone number and pager number after the procedure and told me to contact him if I needed to. He didn't answer so we decided to go to the e.r. because my wife was in so much pain. We get to the e.r. early weds. morning at around 1:30am and the doctors find out on Thurs evening that she received a puncture to her small intestines during the tubal ligation on Tues. So from Tuesday to thurs. evening her bowels were leaking. After the repair was done it took the doctor an additional 2 hours and 6 gallons of cleaning fluid to clean her insides out due to the leakage. She had to spend 4 days in the i.c.u. strapped down to a bed with a ventilator shoved down her throat going to her lungs, a tube going up her nose going down to her stomach to pump her stomach due to her intestines being temporarily shut down and 3 separate holes in her stomach with tubes in them to drain fluids. She was on heavy pain meds while she was in the i.c.u. but she was not sedated during her stay in the i.c.u. So she was aware of what was going on and she was suffering. She's been in the hospital for almost 2 weeks now and they say she has to be in the hospital for another 2 weeks due to her lungs collapsing at the bottom and she has multiple infections.My wife is 27 years old and she was in perfect shape before all of this. Do I have a case?
