My question involves insurance law for the state of: California
I was recently in a three car collision. I was rear ended by an svu that was rear ended by a drunk driver in a Pontiac- I was at a complete stop at a red light. I was driving my mothers car and I was unaware that I was an excluded driver. The damage to her car is extensive. When I tried to file a claim with my mothers insurance they said they were denying the claim because I am excluded.
The middle cars insurance contacted me because they added me to their claim because I was on the police report. They informed me that according to the police report the drunk driver did not give insurance information and was driving a car not registered to him ( I'm currently waiting for a copy of the police report in the mail). The insurance also went on to inform me that they have not been able to locate the driver or the owner of the car.
My neighbor referred me to an injury lawyer. I spoke with him and he claims that if I go through him that they will find the at fault driver and go through him to get my moms car fixed and for any medical procedures I need. I was not seriously injured in the accident-some tension in my back but, my passenger received a concussion. He said if all fails with the at fault driver he can go through my moms insurance and fight the excluded drivers Claus.
My main questions are:
Is it worth going through this injury lawyer?
Is the middle car liable in any way? Possible stopped to close to my car?
Is there really a way to get around the excluded driver Claus?
If I pay for the damages and I do get insurance coverage somehow will they Reimburse me for my out of pocket expenses?
