F Visas: Entry With a F1 Visa With Pending Criminal Charges in Europe

Dear all,

I live in France, and in 2012 i had sexual intercourse with a 15yo when I was 18 at a party in another european country. She claimed I abused of her -which I DIDN'T- and I was imprisoned for 2 nights. A pre-trial was scheduled, but it was annulled when some developments in my favor came up and I was released.

I still face 10 years of jail as the case is pending. The deadline is in some months but (HOPEFULLY) it may be closed with no trial as all of the evidence and experts opinions collected by the investigators are in my favor.

I study Finance in my country and I want to go on exchange to the US next year. I already have an F1 visa expiring in 2016 from my exchange year in 12th grade.



Do I need to re-apply for the Visa?

What if the charges are still pending at the time of application?

Will I be asked to provide information about the thing even if the case is closed before my application?

If the charges against me are dropped with no trial, will this thing be in my criminal record? I want to be a banker in the U.S., I am very afraid that his horrible tragedy may jeopardize my future.
