My question involves a child custody case from the State of: California. My daughter is 10. Her father has been in prison for the last year and will be out in about 7 months. This is his 2nd time to prison since my daughter was born. We were never married and never went to court for custody. When he was out of prison he would see my daughter every other weekend. I would like to file for sole legal and physical custody of my daughter. I will allow him to have visitation when he gets home. My question is.,,, since we were never married and never had a custody order do I need to file or do I already have full custody. If i do need to file am I being reasonable in assuming that I have the right for sole legal and physical custody?
