Breaking a Lease: Breaking a Lease Due to Domestic Violence

mardi 25 novembre 2014

My question involves landlord-tenant law in the State of: Washington

Hi, my friend has a restraining order against her ex-boyfriend, she's moved once to escape him but he has now found her and has been repeatedly harassing her at her new apartment.

Her lease is not up until next summer. And she is "allowing" him in to her apartment when he comes over, she does not want him there but she feels like she has no choice - but she is in violation of the restraining order as well by letting him in.

Now she doesn't want to try and break the lease because she's afraid that the manager will say that she has been letting the ex come over.

This man is extremely violent and there are small children involved as well.

So can the manager refuse to allow her to break the lease based on the fact that he has seen her with the ex?

Can she get in trouble for allowing him in rather than calling the police when he comes over? (I think she has a choice but she feels like she has no choice in letting him in even with the restraining order.)

And what is the process for breaking the lease?

Thank you!
