Criminal Investigations: Police K9 Probable Cause for Search in Washington and Impound for Refusal

mardi 23 décembre 2014

My question involves police conduct in the State of: washington

My question is regarding no consent impound of auto based off k9 alert on drugs after Marijuana was disclosed and found by officers prior to k9 being called in to search?

*What scope for investigation can officers use for k9 in wa state for drug search if possesion of marijuana is legal

*if marijuana was disclosed to officer on traffic stop (failure to use turn signal) but was within wa state law for possession what grounds for more investigation are there?

* are police k9's trained to alert on some drugs and not others (field officers not special units)

***summary of incident...

good friend was driving a vehicle (not his) got stopped for failure to use turn signal, police asked about vehicle he explained he was using it disclosed he had 1 gram of marijuana in center console (legal in wa state) police asked for consent to search he refused, police took him and female passenger out of vehicle brought k9 to search k9 alerted after officer did walk around police released him and passenger and impounded the vehicle for court order to search. he recieved notice from sheriifs office to turn himself in he did police say they recoverd 5 lbs of class 1 controlled substance from inside of door now he is charged and owner says he had no idea looking for any insight on what is permissable for the officers to use concerning the scope of investigation? or any good ideas for suppressible issues????
