Mental Health: 5250 Firearm Prohibition, What Type of Weapons Are Prohibited

lundi 22 décembre 2014

My question involves public health law in the State of: California.

If a person were to have been placed under a 5250, and subsequently an LPS conservatorship for initially gravely disabled and danger to self, followed be rehearing and a determination of gravely disabled (but not danger to self), followed by a petition to reestablish being denied and a determination of no longer being gravely disabled, that person loses his or her federal right to bear arms? What is considered a prohibited weapon? Is an air pump rifle considered a prohibited weapon? They do not require background checks to purchase from my understanding. I believe at the 5250 hearing the petitioning psychiatrist marked the check box that he did not feel the person should not be able to possess a firearm, nor did he feel the person should not be able to drive a motor vehicle, although the 5250 and conservatorship were established.

Are there any weapons a person with a lifetime federal ban can possess? Have any of the new laws made provisions for federally regaining RKBA (namely HR2640)?

Thanks!
