Ownership Rights: Automobile Co-Owner Rights

lundi 23 février 2015

My question involves personal property located in the State of: Alabama

My husband co-signed on a car loan for our daughter who was a recovering drug addict, clean 2 years. The deal was for her to make the payments and build up her credit. Shortly after buying the car in Nov 2014, she relapsed. The title is issued to "our daughter" OR "my husband", so I realize they each have equal rights, however, when she failed to pay the installments, my husband was called. He paid off the loan and we would like to take possession of the car for numerous reasons, i.e., illegal activities (she's been in jail twice) and our liability for what she does in that car. Are there any legal repercussions for us if we have it 'repossessed' (or towed)? Is there any way to get her name off the title without her signing it? (DMV told him that they did not verify signatures, wink, wink, but he won't do anything illegal like that.) We would rather not sign the car over to her, but if that's the only way to limit our liability, we'll consider it. Any help would be appreciated! Thanks.
