Discrimination: Jr High Principal and Police Harassing Student

My question involves education law in the State of: Texas



My 16 year old step son is a recovering drug addict going on a year clean and sober. He is on probation and receives frequent drug test and has never tested positive.

After missing a year of school from being in drug rehab and recovering from paralysis as result of smoking synthetic marijuana he returned to school where principal tried her hardest to not let him return. After we won that battle she has constantly harassed him by subjecting him to searches, telling other student not to associate with him because "he is a bad kid", telling him that " I think you are still on drugs", vocally cheering when school police has brought him to be searched, having the school police follow him around school and even sit behind him in class. After 5 months of this they still have not found anything to pin on him even though he did get suspended while they had a pending investigation of kids in the school selling drugs which they found had nothing to do with him. The strange thing is his probation officer has been to the school twice and they have never voiced their concerns to him



The boy has came a long way. He is making good grades, his teachers adore him, and has had no issues with other students but still he is subjected to all this. We have been to the school 3 times asking for this to stop but it still continues. Now he is depressed and suicidal and is terrified of going to school for fear of what they will do to him next but he still goes. What legal action can we take against the school or school board?
